How to Obtain Private Security Agencies License in India?

Security agencies are the organizations engaged in offering security solutions
like training of security guards to any business or industrial organization or
company, or any other property or person. In India, the private security
operations are handled by the Private Security Agencies Regulation Act 2005. We

the Private Security Agencies Regulation Act, 2005
The
Private Security Agencies Act, 2005 manages all aspects of private security
agency’s operations and business in India. The Act extends to the entire
country except Jammu & Kashmir and has been in existence since June 2005.
How
State Government appoints Controlling Authority?
The
Act requires all the state governments to assign a controlling authority not
below the rank of Joint Secretary in Home Department or similar officer for the
state. The controlling authority is responsible to issue PSARA license for UP,
regulation and renewal of operation of private security organizations. Along
with it, the Act also enables state government to make rules to conduct the
provisions of the act. Hence, a lot of states have assigned the rules of
Private Security Agencies to discharge responsibilities of State Government
effectively under the Act.
How
to Obtain Private Security Agency License?
According
to the Act, no one can start or operate private security agency without
obtaining PSARA license for Delhi.
Along with it, no private security agency can assign security outside India
without permission of Controlling Authority which will consult Central
Government before assigning this permission. So, anyone who wants to start the
business of security agency should be licensed in India.
Eligibility
for PSARA License
Only
Indian firm, company, or association or people can apply for PSARA license. In
addition, if agency is a company, majority shareholders must be Indian
residents. Here are the conditions that should be fulfilled –

The company or person cannot be convicted of
offense related to the formation promotion, and management of company (any
misfeasance or fraud by him related to the company), including undischarged
insolvent,

The company or person shouldn’t be convicted
by competent court for any offence, and its prescribed jail term shouldn’t be
less than 2 years
·
The person cannot be dismissed from the
government services on moral turpitude or grounds of misconduct
·
The company or person shouldn’t be keeping
links with any association or organization which is banned under any law for
their activities which can affect public order or national security.
Fee
to Obtain PSARA License
Here
are the government fees to obtain PSARA security license –
·
To operate in one district – Rs. 5000
·
To operate in up to 5 districts – Rs. 10000
·
For entire state – Rs. 25000
